The Programme
The Diplomatic&ME Programme (hereinafter referred to as "Diplomatic&ME") is a Loyalty Programme, owned by Diplomatic Supply Service s.a., with registered offices at Avenida Suiza 4, PolÃgono de Actividades LogÃsticas, 28821-Coslada, Madrid, Spain, and tax identification number A-28286631 (hereinafter referred to as "Diplomatic"), managed and operated by Diplomatic.
Purpose of the Programme
The purpose of Diplomatic&ME is to reward customers. For this purpose, the Cardholder will receive a card where he will accumulate points for the actual and paid purchases of products and services not subject to promotions and/or offers. Such points will serve to reduce the amount of future purchases as set forth in these Terms and Conditions.
Titularity
The status of Diplomatic&ME holder is acquired by completing the registration form on the Diplomatic&ME website or at Diplomatic's Duty Free Shop. The holders of Diplomatic&ME are hereinafter referred to as ("Holder", "You" or "Member"). Only individuals over 18 years of age may be holders of the card. Acquisition of ownership of Diplomatic&ME is subject to acceptance of these Terms and Conditions which supersede and replace in their entirety any earlier version of these Terms and Conditions. It is understood that you expressly accept these Terms and Conditions by registering with Diplomatic&ME. The card is personal and non-transferable and will identify the Member with his/her personal data and account number, enabling him/her to participate in Diplomatic&ME. Individuals who become Cardholders will have a single personal account and will receive a card that will credit them as members of Diplomatic&ME. In the event of loss, theft or damage, the customer must notify the Customer Service Centre, and Diplomatic shall not be liable for any improper or fraudulent use made of the card prior to receipt of such notification. Each Cardholder may only use one card per person. It is forbidden to sell, change or assign by any means the card that accredits you as a Cardholder. The cardholder is solely responsible for the personal data provided to Diplomatic for registration with Diplomatic&ME, as well as for updating the data if necessary, and undertakes to update the data by any means (website, email, Duty Free Shop, etc.).
Earning promotional points
Promotional points are those that Diplomatic offers to the Member without being linked to any purchase. They will be accumulated only in the account of the Holder beneficiary of these points.
Types of promotional points
- Diplomatic&ME Welcome Points.
- These are only for Diplomatic Supply Service customers who have never signed up for a company loyalty program. This customer, whom we call the Holder, will receive welcome points just for registering. Any person who registers with Diplomatic&ME as of the entry into force of these terms and conditions, i.e. on 1 July 2016, will be considered a new Holder for this purpose, provided that such registration has been made through one of the following direct channels: the website diplomatic.com or the Downtown Duty Free Shop. Likewise, in order to obtain the welcome points, it is essential that the new holder completes the Diplomatic&ME registration form in full, including the date of birth and the postal address of his/her current diplomatic mission. You can complete your profile via the website diplomatic.com/ME.
- Welcome points to the next diplomatic mission.
- The Holder will receive welcome points on their first order at a new destination each time they change diplomatic missions, provided they have previously made a purchase through the Diplomatic&ME program during their previous mission and their new mission is not already a client of Diplomatic.
- Other promotional points.
- All points received by the Member that are not linked to any purchase.
Obtaining points generated
The points generated are those that the Member earns upon completing a purchase. They will only be accumulated in the account of the Holder to whom the purchase is invoiced, regardless of the natural or legal person making the payment of the corresponding invoice, whether it is the Holder themselves or any other person or entity. The points accumulated are those that appear on the purchase invoice.
Under no circumstances will points be generated or accumulated in the following cases:
- For products and/or services paid for through the exchange of points.
- For products with some kind of discount or offer, unless otherwise indicated.
- In the event that the invoice is not paid in full.
- In the event that the Member has a balance due for payment.
In the case of purchases made through the exchange of points, no points will be accumulated on the portion paid with points. In order to obtain points and enjoy the advantages associated with Diplomatic&ME, it is essential to identify yourself as a Diplomatic&ME holder, either with your registration email or with your Diplomatic&ME card number, when making the purchase, and to ensure that the details of the holder match those on the invoice. Points are generated based on the Duty Free price, excluding taxes and fees of any kind.
The points will be transferred to your account as soon as the invoice has been paid in full and within one (1) to seven (7) days.
Additional benefits of Diplomatic&ME
The holder can access the benefits of Diplomatic&ME at any time via the website diplomatic.com/ME.
Promotions
All promotions will be available on the website diplomatic.com and special promos will be informed by email.
Redeeming points
Customers in Madrid will only be able to redeem points at the Zurbarán 30 Duty Free shop. Promotional points can be applied on the first order or on the date indicated in the promotion. Other points generated may be redeemed from the next day of billing the order that generated the points.
For the rest of our customers, points may be redeemed in the shopping cart before completing the purchase.
Points may be redeemed at a maximum of 50% of the order value at Diplomatic&ME (not considering products with any type of offer or promotion), subject to the possibility of this figure being revised or modified by Diplomatic at any time.
Expiration of points
Diplomatic&ME points are valid for 12 months for our customers in Madrid and 24 months for the rest of our customers, from the invoice date of your last order. Diplomatic reserves the right to offer different expiry dates and special conditions. After the expiration date, the points will be withdrawn from your account without prior notice, waiving any claim in this regard.
Transfer of points
Points are non-transferable.
Claiming points
The Member shall have the right to make complaints if, in his opinion, the information on his account and/or transactions sent by Diplomatic&ME is incorrect, in accordance with the applicable Terms and Conditions. The Member may submit the corresponding claim through the website diplomatic.com/ME or through the Customer Service Centre, providing, in any case, the number of the invoice/purchase voucher number or the contracted service related to the claim. In all such cases, Diplomatic's liability shall be limited to correcting the error once the Member has established his right in good faith. In telephone communications, the Member must prove his/her identity by answering personal identification questions from the service operator. Claims made by the Member may be processed within six (6) months from the invoice date; after this period no claim for unallocated points will be accepted, and the Member expressly waives any claim to this effect.
Application for cancellation by the Member
At any time the Holder may unsubscribe from Diplomatic&ME. To do so, the Member must communicate this in writing, through the website diplomatic.com/ME or by sending a copy of the ID card or passport to the following address: Diplomatic Supply Service S.A. (LPD Department), Avenida de Suiza, 4 - 28821 Madrid (SPAIN), or send this documentation to: [email protected]. This voluntary resignation will mean the loss of all your points and benefits automatically at the same time that your card is deactivated, and you lose your status as a Member.
Cancellation of accounts and cards
Accounts that remain inactive for more than one (1) year will be automatically canceled without prior notice to the Account Holder, resulting in the loss of all accumulated points. An account will be considered inactive if the Holder has not accumulated points from purchases made with Diplomatic&ME and/or obtained or redeemed points through any of the options offered by Diplomatic&ME for a period of two (2) years or more. Additionally, Diplomatic may, at its discretion, cancel the account and block the card of any Cardholder if, in Diplomatic's opinion, it is being used improperly to obtain or exchange points, or if the payment of any invoice for purchases made by the Cardholder is not fulfilled. In the event of account cancellation due to improper use of points, no new requests or applications for registration will be accepted from the same individual as a holder or member of Diplomatic&ME. If the account is canceled due to inactivity, the Member may request reactivation, but may not use the points balance forfeited due to inactivity.
Exception: The only exception is that if the account has been dormant for less than 12 months, the Member must allege and justify the inactivity by returning to his country. Points and status will be maintained for the next diplomatic mission, and the Holder must inform the new mission of the date and destination to avoid account cancellation.
In the event of the holder's death, the account will be cancelled.
Liability disclaimer
Diplomatic assumes no liability whatsoever for products and services marketed or provided by third parties and shall not be liable for any loss of gifts, correspondence, incorrect addresses, delays in the receipt of gifts, etc., nor for the theft or exchange of unauthorized points or the use of points and benefits as a result of circumstances beyond the control of Diplomatic&ME. Diplomatic reserves the right to correct any errors without prior notice, whether typographical, price, points, descriptions, etc. in relation to Diplomatic&ME. Diplomatic shall not be held responsible for any correspondence lost or delayed in the physical or electronic mail of the Holder, nor for any errors of description, typographical or pricing errors printed on the material sent to the Holder, and reserves the right to correct them and may be consulted on the website diplomatic.com/ME.
The present Terms and Conditions, as well as all the promotions, etc. related to Diplomatic&ME duly updated, may be consulted at any time on the website diplomatic.com/ME.
Modifications to Diplomatic&ME
Diplomatic may unilaterally modify the structure of the operation of Diplomatic&ME at any time. In this case, Diplomatic will notify the Holders on its website or by e-mail at least 15 days in advance of the new operating structure of Diplomatic&ME and the Terms and Conditions that will govern it, as well as the date from which it will become effective. If the effective date is not indicated, it will be understood that the modifications are effective the day after the e-mail or the publication on the website, whichever is earlier. The Holder who does not wish to continue at Diplomatic&ME in accordance with the new structure and conditions of Diplomatic&ME may redeem all the points on his account in accordance with the old structure and conditions within three (3) months from the date of notification or publication of the change in the conditions of Diplomatic&ME. The Member who wishes to take advantage of this possibility and redeem his or her points in accordance with the above form must make such redeem by calling the Diplomatic Customer Service Centre at the telephone number indicated on the website diplomatic.com and indicate his or her situation accordingly. After the three (3) month period indicated, the Holder shall cease to be a member of Diplomatic&ME. For the purposes of the foregoing, the Terms and Conditions governing the operation of Diplomatic&ME shall be published at all times on the website diplomatic.com/ME.
Diplomatic reserves the right to cancel Diplomatic&ME at any time for commercial reasons of internal company operations. This fact will be notified to the Member, who will have three (3) months from the date of notification to redeem all the points that appear in his account. Once this period has elapsed, all accumulated points will be automatically cancelled, without any right to compensation in favor of the Holder of the points, without any right to claim anything from Diplomatic for this reason from that moment onwards. Diplomatic&ME shall be cancelled without prior notice or liability and the provisions of this paragraph shall not apply if at any time circumstances of force majeure or legal constraints prevent its continuation or development.
Integrity
If any provision of these Terms and Conditions or the application of any provision shall be deemed unlawful, invalid or unenforceable, in whole or in part, under any Law, such provision or part thereof shall be deemed not to have been made but the legality, validity and enforceability of the Terms and Conditions and the application of such provision to other persons or in other circumstances shall not be affected. This clause shall have no effect if the fundamental nature of this Agreement is altered or if it is contrary to public policy.
Applicable law and jurisdiction The Diplomatic&ME Terms and Conditions
Diplomatic&ME is governed by the regulations in force in Spain and, for any matter arising in connection with the interpretation and application of these General Terms and Conditions, the parties expressly waive any jurisdiction to which they may be entitled and submit themselves expressly to the jurisdiction of the courts and tribunals of Madrid.
Personal data protection
According to the provisions of Article 5 of Organic Law 15/1999 on Data Protection and Article 12 of Royal Decree 1720/2007, by registering for Diplomatic&ME, you expressly consent to the collection and processing of the data provided throughout your relationship with Diplomatic through Diplomatic&ME. This data will be stored in a file owned by Diplomatic, with its registered office at Avenida de Suiza 4, PolÃgono de Actividades LogÃsticas, 28821-Coslada, Madrid, Spain, and CIF number A-28286631. The purpose of this data processing is to manage the operation of Diplomatic&ME, provide you with the best customer service, and send you commercial information via email, mobile channel, telemarketing, or mailing about Diplomatic's products and services. We inform you that you can exercise your rights recognized by law at any time, particularly the rights of access, rectification, cancellation, and opposition, by writing to Diplomatic’s address as indicated above or by sending an email to [email protected], properly identifying yourself (Ref. Data Protection).
In accordance with the provisions of Organic Law 15/1999, of 13 December, on the Protection of Personal Data (LPD), a personal data file has been created in which the data required for the operation of Diplomatic&ME are collected. Diplomatic guarantees the adoption of appropriate measures to ensure the confidential treatment of such data, and in the event that you do not agree with the treatment or transfer of your personal data, you may write to Diplomatic's Customer Service Centre, which is responsible for and manages the files, at the above address, where you may also exercise your rights of access, rectification, cancellation and opposition.
Diplomatic may also log your IP addresses to diagnose any problems with our server, to administer our website and to analyze user trends.
